The Evolution Of ADR

The usage of ADR in a number of dispute contexts continues to grow rapidly nowadays, and has been institutionalized to a large extent with the introduction of legislative schemes and with the development of professional bodies that have fostered the usage of ADR processes. Many experts have noted by commentators that ADR processes aren’t ‘new’ but favour been rediscovered, as informal justice mechanisms have long been the dominant means of dispute resolution in several societies, and in Indigenous communities particularly. The ‘rebirth’ of ADR is often from the development of group justice centers to end neighborhood disputes inside 1970s and 1980s. Eventually, the use of ADR processes spread into the areas, such as family, environmental, commercial and industrial disputes.
